Terms and Conditions
These Terms and Conditions govern the contractual relationship between Kreis AG (the "Provider") and the customer (the "Customer") in relation to coaching services offered under the Kibernetik brand. By booking a service the Customer accepts these terms.
1. Contracting party
The contracting party is Kreis AG, Musterstrasse 1, 8000 Zürich, Switzerland.
2. Services
The Provider offers individual coaching, training and mentoring services according to the respective module description or individual agreement. Scope, location and date are confirmed in writing or by email before the contract is concluded.
3. Conclusion of contract
The contract is concluded upon written or electronic confirmation of the booking by the Provider. Verbal side agreements only take effect upon written confirmation.
4. Prices and payment
Prices in the offer or booking confirmation apply in Swiss Francs (CHF) plus any applicable VAT. Invoices are due net 14 days from the invoice date. In case of default, interest of 5 % p.a. is charged.
5. Customer obligations
The Customer is responsible for ensuring the prerequisites necessary for the service (physical fitness, materials, equipment) and for arriving on time. The Customer participates in coaching sessions at their own risk.
6. Cancellation and rescheduling
- Cancellation or rescheduling up to 14 days before the appointment is free of charge.
- Between 14 and 7 days before the appointment, 50 % of the fee is owed.
- Less than 7 days before, or no-show, the full fee is owed.
- In case of force majeure (in particular weather), an alternative date is offered.
7. Liability
The Provider is liable only for damage caused by gross negligence or intent. Liability for ordinary negligence, indirect damage, consequential damage and loss of profit is excluded to the extent permitted by law. Participation in coaching sessions is at the Customer's own risk.
8. Intellectual property
All materials, videos and documents provided by the Provider remain its intellectual property. Distribution or publication without prior written consent is not permitted.
9. Privacy
Processing of personal data is governed by the Provider's privacy policy.
10. Changes to these terms
The Provider reserves the right to amend these terms. Existing bookings are governed by the version in force at the time of booking.
11. Governing law and jurisdiction
Swiss law applies exclusively, excluding conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the registered seat of the Provider, to the extent permitted by law.
